What is Karta?

Karta of HUF: In Hindu law, Karta is the head or manager of a Hindu Undivided Family (HUF). The Karta has the authority to make decisions on behalf of all coparceners and members of the HUF and has control over the management of HUF property.

The HUF Karta makes decisions for the benefit of the family members and represents the HUF in business, taxation, and legal matters. The Karta is responsible for managing the income earned by the HUF and distributing it among the members as per Hindu law.

Duties and Powers of Karta

The Karta of an HUF is considered the principal decision-maker of the family. It is their duty to act in the best interest of the entire HUF. The duties of the Karta include making decisions in matters related to business investments, property management, distribution of income, and other family affairs. The Karta also manages the financial affairs of the HUF, including taxation, banking, compliance, and investments.

While the Karta has wide powers, these powers are not absolute. The Karta can alienate (sell or mortgage) HUF property only in cases of legal necessity, benefit of the estate, or indispensable family duties. Adult coparceners have the right to challenge a transaction in court if it is not for legal necessity or family benefit.

Who can be Karta of the HUF?

The senior-most coparcener of the Hindu Undivided Family is generally considered the Karta. After the amendment to the Hindu Succession Act in 2005, a daughter who is a coparcener can also become the Karta of an HUF.

The role of Karta in HUF includes:
