      NRIs may need to file an Indian income tax return if they have taxable income or other filing requirements in India. Common sources include Indian salary, rental income, interest, capital gains, dividends, or income from other Indian assets. The applicable ITR depends on the taxpayer's income and circumstances.

      Indian tax residential status is determined based on factors including the individual's period of stay in India and other statutory conditions. For AY 2026–27, the Income Tax Department states that an individual generally becomes resident based on the applicable 182-day test or the 60-day plus 365-day test, subject to specific provisions and exceptions.

      U.S. persons may have U.S. reporting obligations for Indian and other foreign financial accounts. If the aggregate value of reportable foreign financial accounts exceeds $10,000 at any time during the calendar year, an FBAR may be required. Whether an account is reportable can depend on the taxpayer's status and the nature of the account.

      FBAR and Form 8938 are separate U.S. foreign-asset reporting requirements. FBAR is filed electronically through FinCEN when applicable foreign financial accounts exceed the relevant threshold, while Form 8938 is attached to the federal income tax return when applicable specified foreign financial assets exceed the relevant threshold. Some taxpayers may need to file both.

      Not every NRI automatically needs to file Form 8938. U.S. taxpayers with specified foreign financial assets must generally file when the applicable reporting thresholds are exceeded and no exception applies. The thresholds depend on factors such as filing status and whether the taxpayer lives in the United States or abroad.
