Clear answers to the most common questions NRIs have about filing income tax returns, DTAA, Form 67, and more.
NRIs may need to file an income tax return in India if their Indian income or other applicable filing conditions require a return for the relevant tax year. This can include income from Indian property, interest, capital gains, dividends, salary or other taxable sources. Your residential status, income sources and applicable tax rules determine whether you need to file an NRI income tax return in India.
The ITR form for an NRI depends on the individual's income sources and filing circumstances. For AY 2026–27, ITR-2 is applicable to individuals and HUFs, including non-residents, who do not have income chargeable under business or profession and may have income such as salary, house property, capital gains or other sources. Individuals with applicable business or professional income may need another ITR form, such as ITR-3.
An NRI is generally subject to Indian tax on income that is taxable in India based on the applicable tax rules. Common examples include rental income from Indian property, interest from Indian accounts, capital gains from Indian assets, dividends and other Indian-source income. The tax treatment can vary depending on the nature of the income, residential status, applicable exemptions and DTAA provisions.
Rental income from property located in India is generally considered for Indian income-tax purposes, subject to the applicable rules for income from house property. An NRI may also be subject to TDS on rent paid to a non-resident, where applicable. The final tax liability depends on the rental income, eligible deductions, TDS and other applicable tax provisions.
NRI capital gains tax depends on the type of Indian asset sold, its acquisition and transfer details, the applicable holding-period rules, the nature of the gain and the tax provisions applicable to the relevant tax year. NRIs may have capital gains from Indian property, shares, mutual funds or other investments. The applicable exemptions, deductions, TDS and DTAA provisions should also be reviewed where relevant.
